What are the purposes of dealing with personal data?

The personal data of the person concerned is treated in order to manage and develop the services employed. Also, the personal data of the Interest may be treated for the following additional purposes, provided that they have been consented by the interested party:

- Sending commercial promotions information and communication with respect to the services contracted and requesting participation in opinion polls, for which we will be able to make purchase profiles and habit analysis based on the information obtained.

- Data inclusion in a database shared by BSMSA, PATSA and CBSA.

- Information and communications drama in relation to the services, activities and promotions of the BSM Group, for which we will be able to make purchase profiles and habit analysis from the information obtained.


How long will we keep the data?

The personal data provided by the Interest will be retained while the contract concluded between the Interest and the BSM Group is in force, and once it is terminated, it will be blocked until the applicable limitation deadlines are exceeded.

If you have given your consent to the processing of the data, until the person concerned requests deletion, when they will be blocked until the applicable limitation periods pass.

What legitimizes us for dealing with the data?

The legal basis for the processing of the Interest's personal data is the execution of the contract. In this respect, the person concerned is obliged to provide the data necessary for their implementation. If we do not receive this data, it will not be possible to conclude the contract.

With regard to the other treatments, the legal basis is the consent of the interested party, which is both prior and unambiguous.
 

Which recipients can we communicate the data to?

The personal data of the Interest may be ceded to the following recipients:

- BSM Group business.

- Public administrations where this is established by an applicable legal provision and courts.

- Providers who provide services to the BSM Group relating to the management of the formalised contract and who are in charge of the treatment. In any case, third parties with which certain personal data are shared from the Interest will have previously confirmed the adoption of appropriate measures for the correct protection of data.


What are the rights of those concerned in relation to the data they provide?

Anyone has the right to obtain confirmation as to whether we are dealing with personal data that concern him or her. The persons concerned have the right to access their personal data, as well as to request the correction of the inaccurate data or, if necessary, to request deletion when, among other reasons, the data is no longer necessary for the purposes for which they were collected.

In certain cases, the Interestee will have the right to request that the processing of his data be limited, a case in which we will only retain them for the exercise or defence of complaints.

Under certain circumstances and for reasons related to their particular situation, stakeholders may oppose the processing of their data. In this case, the entities in the BSM Group to which this right is exercised will cease to deal with the data, except for urgent legitimate grounds or the exercise or defence of possible claims

In any previous case, the corresponding entity of the BSM Group will communicate any correction or deletion of personal data, as well as any limitation of treatment carried out, to each recipient who has been informed of personal data, unless it is or requires a disproportionate effort. If requested by the Interested, the entity of the BSM Group in question will inform you of the aforementioned recipients.

In addition, the Interestee will have the right to receive the personal data that it is entitled to and that has provided BSM, in a structured format, in common use and mechanical reading, and to transmit them to another responsible when treatment is based on consent or contract, and is carried out by automated means.

The Interestee will have the right to oppose at any time, for reasons relating to his particular situation, the personal data concerned being treated on the basis of public or legitimate interest by the BSM Group or a third party, including profiling, so that BSM or another BSM group entity will cease to treat personal data, unless they can give them legitimate, imperative reasons for treatment that prevail over the interests, rights and freedoms of the Interest, or for the formulation, exercise or defence of claims.

Furthermore, the Interest will have the right not to be the subject of a decision based solely on automated treatment, including profiling, which will produce legal effects or significantly add it, unless this decision is necessary for the conclusion or execution of a contract with BSM or another entity of the BSM Group and is authorised by the current European or state legality or based on the explicit consent of the Interest.

How do we get the data?

The personal data that we treat the different entities of the BSM Group comes from the self-interest and from the City of Barcelona.

The categories of data discussed are as follows:

- Identification data

- Mail or Email addresses

- Economic Data

- Commercial Information

For the purposes described above BSM does not treat particularly protected data.


Phone Call Recording

BSM.SA will deal with phone call recordings using the call recording system as follows:

PURPOSE: Manage data for the provision of services BSM.SA provides to its users. As well as information, consultation, monitoring of the services provided, and everything that refers to compliance with the company's purposes and functions.

LEGITIMIZATION: The legal basis for the treatment of telephone tapping is in compliance with obligations and functions established by BSM.SA and to provide legal certainty.

At a time when the interlocutor holds a telephone conversation with any of the people who respond from BSM.SA, it is understood that he consents to recording and is given to report anything that the Act requires in the field of personal data protection. The consent of the interested party in any case legitimises the Company to deal with its personal data.

In any case, the recording of the call will be reported, and the call may not consent and end.

Videovigilance

BSM.SA will treat captured images using camera and video camera systems (in recording and real-time viewing modalities) according to the following information:

PURPOSE: Preserving the safety and protection of people and goods, as well as preserving the safety and operationalness of the equipment and facilities of the entity.

LEGITIMIZATION: The legal basis for image processing through camera or video camera systems in the entity's facilities is:

Compliance with a mission of public interest to ensure the safety of people, goods and facilities.

The legitimate interest in the need for BSM.SA to be responsible for treatment, to establish monitoring measures for the verification of workers' compliance with their labour obligations.

RECIPIENTS: Images may be ceded to the State Security Forces and Corps, as well as to the judge and court in compliance with a legal obligation applicable to BSM.SA as the person responsible for treatment.

CONSERVATION: Images captured using the video surveillance system will be preserved for a maximum period of one month from their capture. It will be abolished, unless it is preserved to testify to the commission of acts that infringe the integrity of persons, goods or facilities.

In cases where the camera system used is real-time viewing, images will not be preserved to the extent that no recording or storage of images is performed.
